Personal data means any information about an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more specific factors related to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
The controller has not appointed a Data Protection Officer.
Sources and Categories of Processed Personal Data
The controller processes personal data that you have provided or personal data obtained based on fulfilling your order.
The controller processes your identification and contact details and any data necessary for fulfilling the contract.
Legal Basis and Purpose of Personal Data Processing
The legal basis for processing personal data is:
- The performance of a contract between you and the controller under Article 6(1)(b) GDPR,
- The legitimate interest of the controller in direct marketing (particularly for sending commercial communications and newsletters) under Article 6(1)(f) GDPR,
- Your consent to processing for direct marketing purposes (particularly for sending commercial communications and newsletters) under Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, in cases where no goods or services have been ordered.
The purpose of processing personal data is:
- To process your order and fulfill the rights and obligations arising from the contractual relationship between you and the controller; when placing an order, personal data necessary for successful order processing (name, address, contact information) are required. Providing personal data is a necessary requirement for concluding and fulfilling the contract; without providing personal data, the contract cannot be concluded or fulfilled by the controller,
- Sending commercial communications and conducting other marketing activities.
The controller does not engage in automatic individual decision-making as defined in Article 22 GDPR. You have given your explicit consent to such processing.
Data Retention Period
The controller retains personal data:
- For the period necessary to exercise rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for 15 years from the termination of the contractual relationship).
- Until consent to processing for marketing purposes is revoked, for a maximum of 15 years, if personal data are processed based on consent.
After the retention period expires, the controller deletes personal data.
Recipients of Personal Data (Controller's Subcontractors)
Recipients of personal data are persons:
- Involved in delivering goods/services and processing payments based on the contract,
- Providing e-shop operation services and other related services,
- Providing marketing services.
The controller does not intend to transfer personal data to a third country (outside the EU) or an international organization. Recipients of personal data in third countries are providers of mailing or cloud services.
Your Rights
Under GDPR, you have the right to:
- Access your personal data under Article 15 GDPR,
- Rectify personal data under Article 16 GDPR or restrict processing under Article 18 GDPR,
- Erasure of personal data under Article 17 GDPR,
- Object to processing under Article 21 GDPR,
- Data portability under Article 20 GDPR,
- Withdraw consent to processing in writing or electronically at the address or email of the controller specified in Article III of these conditions.
Additionally, you have the right to lodge a complaint with the Data Protection Authority if you believe your right to data protection has been violated.
Conditions for Securing Personal Data
The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
The controller has taken technical measures to secure data storage and physical document storage.
The controller declares that personal data are accessible only to authorized persons.
Final Provisions
